Implementation of the Rajasthan Street Vendors’ Act 2012

The Rajasthan Street Vendors Act was passed on 29 August 2011 and came into force on 1 April 2012. The Act mandates setting up of Town Vending Committees (TVC), registration of street vendors and framing of a street vendors’ scheme. Additionally, it lays down the responsibility of monitoring the functioning of the TVCs and implementation of the Scheme on the Municipalities.

Despite the Act coming into force, it has not been implemented due to the lack of will on the part of the Government of Rajasthan. Street vendors continue to face harassment by the police and government officials, who continue to manhandle and arbitrarily evict the vendors, and confiscate their goods. At the same time, neither have TVCs been put in place to facilitate the process of registration of street vendors, nor has any scheme for street vendors been formulated, till date.

In this background, the Centre for Civil Society, Centre for Policy Solutions and Heritage City Thadi Thela Union filed a writ petition (Centre for Civil Society & Ors. Vs Jaipur Municipal Corporation & Ors. (D.B. Writ Petition (PIL) No. 6623 of 2012) ) before the Hon’ble High Court of Rajasthan praying for implementation of the Rajasthan Vendors Act and for stay on harassment and arbitrary evictions of street vendors.
